Depends on the jurisdiction. In theory you should need a licence, ESP if the service is being offered via platform. But with the case of some of these smart contracts, the code would be the house, and I think it would be hard to sue the code. If the code never cashes out the funds, it never realized capital gains, and subsequently has no tax liability. Now that I've typed it out, I guess you are right; essentially offering gambling without a license is illegal. But enforcement in some cases would be almost impossible. Also, while this should be highly illegal, the government is being really cavalier about this at the moment for some reason.
