Did you use VPN whilst connecting to their site? Or did you use Tor? Maybe that's where the confusion was coming from.
I strongly doubt that they would scam for $9 even though their interface seems to be completely copied from Primedice. After all they do have a signature campaign running and the domain name is probably registered with more than $9.
But attempts to doublespend are indeed futile when you take into consideration that they do require 1 conf.
Hopefully he refunds you, because he probably has way more than that in his BTC wallet.
